CAMP OZARK SUMMER STAFF EMPLOYMENT CONTRACT

Congratulations! You have been chosen to be a part of the Incomparable Camp Ozark Staff for the upcoming summer. It will be an intensive job, but one with many rewards. Please read the agreement below carefully. This is your employment contract. Please make sure that your employment dates are the dates you intend to work. Sign and return one copy to Camp Ozark. We look forward to working with you!

***PLEASE MAKE NOTE OF ALL START AND END DATES. YOUR EMPLOYMENT DATES DIFFER FROM REGULAR CAMPER SESSION DATES AND MAY INCLUDE ARRIVING AT THE CAMP ONE DAY BEFORE THE CAMPERS ARRIVE AND/OR STAYING AT THE CAMP ONE DAY AFTER THE CAMPERS LEAVE.

  1. Employment and Compensation
    1. Subject to the terms and conditions of this Agreement, Camp Ozark agrees to employ Summer Staff Member as [POSITION] for Camp Ozark. The Summer Staff Member agrees that their hours and dates of employment and work schedule are set by Camp Ozark and may hereafter be amended. Summer Staff Member is required to attend Staff Orientation on the dates scheduled by Camp Ozark at the beginning of the summer.
    2. The Summer Staff Member shall work during specific periods to be determined, by each Summer Staff Member’s schedule, which will be arranged by Camp Ozark. During these hours, the Summer Staff Member shall devote his/her entire time and attention to the needs of Camp Ozark and the campers. As a condition of employment, Summer Staff Member will not be able to modify this schedule without prior written consent from the Camp Ozark Director or a Human Resources Director.
    3. In consideration of Summer Staff Member’s services and satisfactory performance of this Agreement, Camp Ozark shall provide to Summer Staff Member a salary of $[BASE PAY] (less all applicable tax deductions) per hour in compensation for his/her services rendered as a Summer Staff Member for Camp Ozark.
    4. By signing this Agreement, Summer Staff Member makes the following representations and warranties:
      1. The Summer Staff Member represents and warrants that he/she subscribes to the teachings of James 5:12 and considers his/her word and signature a binding commitment.
      2. The Summer Staff Member represents and warrants that he/she has disclosed to Camp Ozark, in writing, every arrest, charge, indictment, conviction, no contest or guilty plea, or other adjudication of the Summer Staff Member, including deferred sentence or deferred judgment arrangements, for any felony or misdemeanor and/or any other level of criminal offense. The Summer Staff Member understands that a background check and review of references that is satisfactory to Camp Ozark is a condition of this Agreement.
      3. The Summer Staff Member represents and warrants that if prior to the dates of employment or during employment the Summer Staff Member is subject to an arrest, charge, indictment, conviction, no contest or guilty plea, or other adjudication, including deferred sentence or deferred judgment arrangements, for a felony, misdemeanor, or other level of criminal offense, he/she agrees to notify the Camp Director in writing.
      4. The Summer Staff Member represents and warrants that he/she is fully qualified to serve, that all records and information provided in the interview and application process concerning him/her are true and complete to the best of the Summer Staff Member’s knowledge, and that he/she is available for employment, during the times specified.
  2. Specific Employment Duties and Responsibilities.
    1. In consideration of the compensation specified in this Agreement, Summer Staff Member shall act in accordance with the responsibilities enumerated below and with the Job Description, and Personnel Policies, sent with this Agreement and incorporated herein by reference, as they exist now and may be amended in the future.
    2. The responsibilities of the Summer Staff Member may include, but not be limited to, supervision of the campers during all activities and all meals; leadership, as required, of the campers’ activities; explanation and instruction, as required, of campers’ activities; and carrying out responsibilities in specific areas as determined at the sole discretion of Camp Ozark.
    3. Summer Staff Member acknowledges that he/she is in a unique, authoritative position and campers will model their behavior after his/her behavior; therefore, Summer Staff Member agrees to behave in a mature, Christ-like manner to the best of his/her ability. Summer Staff Member may be required to perform other duties or be subject to assignment or reassignment of position, duties, or title at the sole discretion of Camp Ozark.
  3. Termination
    1. The employment under this Agreement is designated “at will,” which means that it may be terminated at any time and for any legal reason by a Camp Ozark Director or Human Resources Director. No person has the option to amend, change or alter employment-at-will status. Camp Ozark is not guaranteeing the Summer Staff Member employment for any specific period of time.
    2. Camp Ozark may, in its discretion, suspend Summer Staff Member from some or all of Summer Staff Member’s duties, temporarily or permanently, with or without pay or time off; reassign Summer Staff Member to other duties; or terminate this Agreement and employment at any time for any reason, including, but not limited to, the following:
      1. A deliberate or major violation of Summer Staff Member’s duties and/or responsibilities under this Agreement or Job Description or the refusal or unwillingness of Summer Staff Member to perform such duties in good faith and to the best of Summer Staff Member’s abilities.
      2. A deliberate or major violation by Summer Staff Member of any applicable law or the Personnel Policies of Camp Ozark.
      3. Any conduct of Summer Staff Member that constitutes moral turpitude or that would, in Camp Ozark’s judgment, reflect adversely on Camp Ozark, including but not limited to, any consumption of alcoholic beverages, the use of any drug, unless prescribed by the Summer Staff Member’s physician, the use in any form of tobacco, marijuana and CBD, inappropriate content on social media outlets, or the use of profane language during the Summer Staff Member’s employment at Camp Ozark.
      4. If this Agreement is terminated and employment is discontinued prior to the completion of the term of employment specified in this Agreement, the Summer Staff Member shall receive the salary earned prior to the date of termination, exclusive of any compensation for room and board. If termination or discontinued employment occurs, the Summer Staff Member may be asked to vacate the camp property immediately. Temporary room and board may be provided at the sole discretion of Camp Ozark.
    3. Notwithstanding any other provision of this Agreement, during the term of this Agreement, in the event the Summer Staff Member suffers from an illness, the Summer Staff Member may seek care from the Camp Ozark’s health center. The health center staff reserve the right to determine whether the health center has the resources to treat the illness, or whether the Staff Member should be referred elsewhere. If the Summer Staff Member becomes seriously ill or otherwise physically or mentally unable to perform one or more of his/her essential job functions under this Agreement, this Agreement may be terminated at the sole discretion of a Camp Ozark Director,  Health Center Coordinator, or Human Resources Director.
  4. Miscellaneous Provisions
    1. The Summer Staff Member shall authorize and request any present or former employer, school, credit agency, military service or other persons having personal knowledge about him or herself, to furnish bearer with any and all information in their possession regarding him or herself in connections with an application for employment. The Summer Staff Member shall agree that a photocopy of this authorization is accepted with the same authority as the original, and the Summer Staff Member shall specifically waive any written notice from any present or former employer who may provide information based upon this authorized request. The Summer Staff Member shall understand this authorization is to be part of the written employment application, which he/she signs. The Summer Staff Member understands that he/she has been given a stand alone, consumer notification that a report will be requested and used for the purpose of evaluating him/her for employment, promotion, reassignment or retention as an employee. All offers of employment are contingent upon receiving a satisfactory evaluation. The standard of satisfaction shall be in the sole discretion of Camp Ozark.
    2. The Summer Staff Member may not assign his/her rights or delegate his/her obligations under this Agreement without the prior written consent of Camp Ozark.
    3. Employment under this Agreement is considered seasonal employment and will therefore be subject to the applicable provisions of Arkansas unemployment law regarding such employment. Any questions about this issue should be directed to the Human Resources Director or the Arkansas Department of Workforce Services.
    4. No waiver of any default in the performance of this Agreement shall be effective unless in writing and signed by the waiving party. The waiver of a particular breach in the performance of this Agreement shall not constitute a waiver of any other or subsequent breach. The resort to a particular remedy upon a breach shall not constitute a waiver of any other available remedies.
    5. This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Arkansas. Invalidity of any portion of this Agreement shall not affect the validity of the remainder of the Agreement.
    6. Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
    7. No representations or warranties contrary to the terms of this Agreement should be relied upon. This Agreement, Job Description and Personnel Policies constitute the entire agreement. Any amendments to this Agreement shall be in writing.
    8. Summer Staff Member acknowledges that he/she has had the opportunity to consult and review this Agreement with an attorney. Accordingly, in all cases, the language of this Agreement shall be construed simply, according to its fair meaning, and not strictly for or against any party.
